Terms and Conditions

Thank you for considering a commission! Below are my terms of service. These exist to protect me and my work--and you! Please let me know if you have any concerns, questions, or qualms with these terms. Thank you!

These terms are listed here and included in every invoice starting January 1, 2020. Once an invoice is paid, it is assumed that the Terms of Service have been read, understood, and agreed upon.
The artist is me, Sara Litzenberger. The commissioner is you, the person who is paying for the artwork. The piece(s) or work are the files, images, videos--artwork--that are being commissioned.

payment

Payment is due upfront. Payment is non-refundable once the artist begins work*. Payment will be made via PayPal invoice sent by the artist to the commissioner via email. Pieces cannot be bought or sold for any cryptocurrency or as NFTs.
Larger projects with multiple pieces may be paid with a 50% upfront deposit, with the remaining 50% paid upon completion, at the discretion of the artist. High-resolution files will not be delivered before the full amount is paid.

delivery

This is a digital art commission. Final files will be delivered digitally, via email or cloud storage service (Google Drive) link—images will be delivered as high-resolution .PNGs, and animated pieces will be delivered as video files or .GIFs, to be specified by the commissioner before the invoice is sent. Deliverables will be agreed upon upfront—any additional aspect ratios, formats, and file types may be subject to additional charges. No product will be printed or shipped by the artist; no shipping address is required.
If no delivery date is specified, the artist will give a quoted timeframe (i.e. 2 weeks, 1 month, etc.). If that timeframe no longer works for the artist, she will contact the commissioner with an updated timeframe as soon as possible.
If a delivery date is specified by the commissioner, and the artist agrees to it, the artist will deliver the final piece by midnight (local to the artist) on that date. If, for whatever reason, the artist cannot complete the piece by the delivery date, she must inform the commissioner with 48 hours notice and offer a new delivery date.
*In the unlikely case a delivery date lapses, the commissioner may ask for a partial refund (up to 50%) and an updated delivery date OR cancellation.

feedback

Notes and feedback may be given by the commissioner, but it is up to the discretion of the artist whether these notes will be addressed, and whether doing so will require further compensation. Smaller, reasonable notes—as determined by the artist—are included for free. If the artist forgets or omits a previously agreed-upon request, she will update to include that request for free.

use

Commissioners should inform the artist of the intended use(s) of the piece(s) upfront. Commissioned pieces may be used for personal or professional use by the commissioner. The commissioner may use the commissioned artwork for any purpose, except: commissioned pieces may not be sold for profit or used in mass production (including, but not limited to, selling t-shirts, enamel pins, stickers, or other merchandise based on the commissioned piece) without the express permission of the artist. Printing merchandise in small batches for personal use or as gifts is welcome. The artist is permitted to post or distribute the piece(s) as an example of their work, but also may not sell commissioned work for profit without the express permission of the commissioner. The commissioner may request the artist keep the commissioned work private, but must do so explicitly and before the final work is delivered. It is against these Terms to "mint" commissions as NFTs, or otherwise sell or trade commissioned work for any virtual or cryptocurrency. It is also against these Terms to include, upload, or alter the delivered work via machine learning or “AI” programs, such as Midjourney, Canva, DALL-E, or similar.

credit

Commissioned pieces do not require permanent visible credit if posted online. However, it is to be understood that credit for the commissioned piece is attributed to Sara Litzenberger (@saracastically, @saracastically_). Commissioned pieces are not to be passed off as work the commissioner—or anyone else other than Sara Litzenberger—created. Ultimately, rights to the work belong to Sara Litzenberger as laid out in these Terms and Conditions.
